By accessing or using Raconteo ("the Service"), you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the Service.

2. Description of the Service

Raconteo is a platform that allows users to create personalized memoir books with guided writing assistance, and then order professionally printed copies. The Service includes:

• Guided assistance for writing your book
• Editing and customization tools
• Professional printing and binding services
• Shipping and delivery of physical books

3. Registration and account

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Protect the security of your login credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity conducted through your account
• Be at least 16 years old to create an account (EU requirement)

4. Pricing and payment

• Prices are displayed on our pricing page and vary depending on book specifications
• Payments are processed securely by our service providers
• We reserve the right to change our prices with reasonable notice

5. Intellectual property

Your content

You retain all intellectual property rights to the content you create with our Service, including texts, images, and finished books. By using the Service, you grant us a limited license to:

• Store and process your content in order to provide the Service
• Share your content with necessary service providers (printers, AI services)
• Display excerpts or examples with your explicit permission

Our intellectual property

The Service, including its design, software, trademarks, and original content, belongs to us and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Attempt to disassemble or extract the source code
• Use our trademarks without permission
• Frame or reproduce any part of the Service

6. Acceptable use

You agree not to use the Service to:

• Create illegal, harmful, threatening, abusive, or defamatory content
• Infringe the rights of others, including intellectual property rights
• Distribute spam or malware
• Impersonate others or provide false information
• Attempt unauthorized access to our systems
• Disrupt other users' use of the Service

7. AI-assisted content

Our Service uses artificial intelligence (Google Gemini) to assist with book creation. By using this feature:

• AI-generated content is provided as-is and may require your review and correction
• You are responsible for ensuring that your final content is accurate and appropriate
• We do not guarantee the quality, accuracy, or originality of AI-assisted content
• You must verify that the content does not infringe on third-party rights

8. Orders and fulfillment

When you order a printed book:

• You will receive an order confirmation by email
• Production and delivery typically take 8 to 15 business days
• Delivery times may vary depending on your location (see our Shipping Policy)
• You are responsible for providing a correct shipping address
• Risk of loss transfers to you upon delivery

9. Cancellations and refunds

EU withdrawal right — Important notice

Under European law, consumers generally have 14 days to cancel an online purchase. However, personalized or custom-made goods are exempt from this right (Consumer Rights Directive 2011/83/EU, Article 16(c)). Since each Raconteo book is manufactured according to your exact specifications and content, orders cannot be cancelled once placed.

• Orders cannot be cancelled because all books are custom-made
• Refunds are only granted for defective or damaged products
• Dissatisfaction with book content does not constitute grounds for a refund

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted or error-free, nor the accuracy or completeness of AI-assisted content.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or goodwill, service interruptions or errors, or actions or content of third parties. Our total liability shall not exceed the amount you paid to us during the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, your breach of these Terms, or your violation of third-party rights.

13. Termination

We may suspend or terminate your account in the event of a breach of these Terms, fraudulent activity, a security risk, or a deletion request from you. Upon termination, your right to use the Service ceases immediately. We may delete your content, although order history may be retained for legal reasons.

14. Governing law and disputes

These Terms are governed by Spanish law. Any disputes shall be resolved through good faith negotiation, then mediation if necessary, and finally by the competent courts in Spain.

15. Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use after the changes constitutes acceptance of the new Terms.

16. General provisions

• Entire agreement — These Terms constitute the entire agreement between you and us
• Severability — If any provision is found to be invalid, the remaining provisions remain in effect
• No waiver — Failure to exercise a right does not constitute a waiver of that right
• Assignment — You may not assign these Terms without our consent
• Force majeure — We are not liable for delays caused by circumstances beyond our control
